Terms of Service – Command Elite Hobbies Pty Ltd
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“the customer,” “you”) and Command Elite Hobbies Pty Ltd (“we,” “us,” “our,” “the Company”) governing your use of our website (the “Site”), any orders placed, and all related services. By accessing the Site, placing an order, or otherwise engaging with us, you agree to be bound by these Terms. If you do not agree, you must not use the Site or purchase our products.
1. Company Information
Command Elite Hobbies Pty Ltd is a Queensland-registered retailer specialising in gel blasters, hobby products, and tactical gear. Under Queensland law, gel blasters are classified as toys. We are not considered a firearms dealer in the state of Queensland and do not provide firearms-related services nor do we claim to be or operate as such.
2. Eligibility and Age Restrictions
You must be at least eighteen (18) years old to purchase gel blasters, knives, or tactical products. By placing an order, you represent and warrant that you meet this age requirement. We reserve the right to conduct mandatory photo identification checks and to cancel or refuse any order online or in-store if age verification cannot be confirmed beyond reasonable doubt.
In Queensland, gel blasters are classified as toys and may be owned or used by persons under the age of 18, subject to safety recommendations. However, you must be at least 18 years of age to purchase a gel blaster. An adult may lawfully purchase a gel blaster for a minor’s use, but minors are not permitted to purchase gel blasters themselves, nor may they transfer or gift a gel blaster to another person under 18 once it is in their possession.
3. Legal Compliance and Buyer Responsibility
You are solely responsible for ensuring that purchasing, possessing, or using our products is legal in your state, territory, or country. Regulations vary, and some jurisdictions prohibit gel blasters altogether. Any information provided on our Site regarding laws is general in nature and may not reflect the most current legislation.
Command Elite Hobbies accepts no liability for the seizure of products by customs, border authorities, or law enforcement, nor for any penalties, charges, or consequences incurred due to non-compliance with local laws.
4. Orders, Pre-Orders and Acceptance
All orders are subject to acceptance, stock availability, and payment clearance. A contract of sale is formed only upon our confirmation of dispatch. We may refuse or cancel an order at our discretion, including for suspected fraud, regulatory issues, or supply limitations.
Pre-orders require full payment at checkout unless explicitly stating otherwise (e.g. pay half now and half on release before dispatching.) and are strictly non-refundable except where we cannot supply the product or a product alternative as per your request and prior agreement. Estimated release dates are provided as courtesy but are subject to change without notice, whether by us or the brand/manufacturer. Customers acknowledge and accept these conditions and risks when placing pre-orders.

5. Pricing, Payment and Billing
Prices are displayed in Australian dollars (AUD) and are subject to change without notice. All prices are inclusive of GST where applicable.
Price matching may be available for stocked items if they meet the following requirements; The item must be in stock and must be carried in a brick and mortar store within Queensland to receive a matched price. On-sale items will be price matched to other stores provided they still meet the above requirements.
You agree to provide accurate, current, and complete billing and account information. By submitting payment details, you authorise us to charge the applicable amount to your chosen method of payment. If your payment is declined or reverted for any reason, we reserve the right to suspend, delay or cancel your order.
We are not responsible for currency conversion fees, bank charges, or third-party payment provider errors.

6. Shipping, Risk and Delivery
Orders within Australia are generally dispatched within twenty-four (24) to fourty eight (48) business hours. Estimated delivery times are three (3) to five (5) business days for standard post within Australia, depending on the carrier and destination. Delivery times are estimates only and not guaranteed.
Same-Day Pick-Up (Click & Collect) - Command Elite Hobbies offers a convenient same-day pick-up option for
online orders through our Click & Collect service. Orders can be collected only from our HQ location, with a minimum 2-hour processing time to allow our team to prepare your items.
This service is available seven days a week, including weekends. Customers will receive a confirmation email
when their order is ready for collection — please wait for this notification before arriving. Bring valid photo ID and your order confirmation for verification at pick-up.
Risk of loss, damage, or delay passes to you once the order is dispatched from our warehouse. Where shipping insurance is purchased/included, claims must be made directly with the carrier. Orders valued over $250 AUD may qualify for free standard shipping, which is uninsured unless otherwise stated.
International customers are responsible for import permits, customs clearance, duties, and taxes. We are not liable for orders delayed, seized, or destroyed by customs.

7. Returns, Refunds and Consumer Rights
Returns and refunds are provided in accordance with the Australian Consumer Law (ACL). You are entitled to a repair, replacement, exchange, or refund if a product is deemed faulty from the manufacturer, significantly different from its description, or otherwise non-compliant with ACL guarantees.
Change-of-mind returns, exchanges or refunds are not required by law and may only be accepted at our discretion. If accepted, orders may incur a restocking fee of up to twenty percent (20%), in which shipping costs are non-refundable and do not apply.
Products that have been misused, modified, damaged through improper handling, or used contrary to instructions are not eligible for return, exchange or refund.

8. Safety, Use and Warranties
You agree to use all products safely, responsibly, and in accordance with applicable laws and guidelines. Gel blasters must not be discharged in public or in any way that could cause harm, damage, or alarm. Protective equipment should always be worn.
Modifying gel blasters or related products may be unlawful and voids any applicable warranty. Unless otherwise stated, products are supplied “as is” and without any express or implied warranty beyond those required under Australian law.

9. Prohibited Conduct
You must not use our Site or products for any unlawful purpose, to solicit illegal acts, to infringe upon intellectual property rights, to harass or abuse others, to spread misinformation, or to interfere with security features of the Site.
10. Third-Party Services and Links
Our Site may contain links to third-party websites or provide access to third-party tools or services such as alternative payment options. We do not control, endorse, or accept responsibility for third-party content, products, or services. Use of third-party services is at your own risk and subject to their terms.

11. User Content and Submissions
By submitting reviews, comments, photos, or other content (“User Content”) to us, you grant Command Elite Hobbies a non-exclusive, royalty-free, perpetual licence to use, reproduce, publish, and display such content in connection with our business.
We reserve the right, but are not obligated, to remove or edit any User Content deemed unlawful, defamatory, abusive, or misleading. You represent that you own or otherwise control all rights to any User Content you submit.
12. Limitation of Liability
To the fullest extent permitted by law, Command Elite Hobbies is not liable for any direct, indirect, incidental, punitive, or consequential damages arising from:
- the purchase, use, misuse, or illegal possession of products;
- Delivery/order processing delays, delivery failures, Theft, or loss in transit;
- unauthorised access to your account or data;
- reliance on Site information which may be inaccurate or outdated.
Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.
Nothing in these Terms excludes or limits rights under the Australian Consumer Law that cannot be excluded by contract.
13. Indemnification
You agree to indemnify and hold harmless Command Elite Hobbies, its directors, employees, and affiliates against any claims, damages, liabilities, or expenses (including legal fees) arising out of your breach of these Terms or misuse of our products.
14. Termination
We may suspend or terminate your access to the Site or cancel an order if you breach these Terms or if your actions may cause harm to our business or reputation. Termination does not limit our right to seek damages or other remedies available under law.
15. Amendments
We reserve the right to update, change, or replace any part of these Terms at our sole discretion. The most current version will always be published on our Site, and continued use of our services constitutes acceptance of the revised Terms.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Queensland, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
