Terms of Service
These Terms of Service constitute a legally binding agreement between you (“the customer”) and Command Elite Hobbies Pty Ltd. By accessing the Site, placing an order, or engaging with us, you agree to be bound by these Directives.
Company Information & Legal Classification
Command Elite Hobbies Pty Ltd is a Queensland-registered retailer specialising in gel blasters, hobby products, and tactical gear. Under Queensland law, gel blasters are currently classified as toys.
We are not a registered firearms dealer in the state of Queensland. However, we acknowledge that our products are classified as firearms, imitation firearms, or prohibited weapons in other Australian states and territories. We operate strictly in accordance with Queensland and Australian Federal law.
Eligibility, Age Restrictions & Verification
You must be at least eighteen (18) years old to purchase gel blasters, lower receivers, knives, or restricted tactical products. By placing an order, you digitally declare and legally warrant that you meet this age requirement.
- In-Store: We strictly enforce a "Think 25" policy. We reserve the right to request valid, government-issued photo identification.
- Online: By completing our checkout process and accepting these terms, you provide legally binding consent that you are 18+. Falsifying your age is a fraudulent act.
- Minors: While Queensland law allows minors to use gel blasters under adult supervision, minors are strictly prohibited from purchasing them. An adult may lawfully purchase a gel blaster for a minor’s use, but may not unlawfully transfer ownership. We reserve the right to cancel any order if age verification cannot be confidently established.
State-by-State Compliance & Restrictions
The legal status of gel blasters varies drastically across Australia. You are solely responsible for ensuring that purchasing, possessing, or using our products is legal in your specific jurisdiction. Command Elite Hobbies enforces the following operational boundaries:
- ZONE GREEN (QLD): Gel blasters are legal to purchase (18+). No license required. Reasonable excuse and concealed transport laws apply.
- ZONE AMBER (SA & NT): Regulated. In SA, classified as Category A Firearms. Orders processed only upon manual verification of a valid State Firearms License. May require shipping to a licensed dealer.
- ZONE RED (NSW, VIC, WA, ACT, TAS): Classified as firearms or prohibited weapons. We do not, under any circumstances, ship assembled gel blasters or receivers to these states. Orders bypassing cart restrictions will be instantly cancelled and refunded.
Parts & Accessories: We ship non-firing tactical gear nationwide; however, the buyer assumes 100% of the risk. If local state police deem an internal part a "firearm component," we accept zero liability for its seizure.
Orders, Pre-Orders & Acceptance
All orders are subject to acceptance, stock availability, compliance verification, and payment clearance. A contract of sale is formed only upon our confirmation of dispatch. We reserve the right to refuse or cancel any order at our discretion, particularly for suspected fraud or attempted shipping to prohibited jurisdictions.
Pre-orders require full payment at checkout unless explicitly stated otherwise. Estimated release dates are provided as a courtesy but are subject to change without notice by the manufacturer. Customers accept these risks when placing pre-orders.
Pricing, Payment & Billing
Prices are displayed in Australian dollars (AUD), inclusive of GST where applicable, and are subject to change without notice.
By submitting payment details, you authorise us to charge the applicable amount. For orders flagged for manual compliance review (e.g., SA/NT), we may "Authorize" the funds and only "Capture" the payment once your firearms license is verified. If your payment is declined, we reserve the right to suspend or cancel your order. We are not responsible for currency conversion fees or third-party payment provider errors.
Price matching may be available for stocked items carried in a brick-and-mortar store within Queensland, subject to our verification and approval.
Shipping, Risk & Delivery Protections
Orders to legally permitted zones within Australia are generally dispatched within 24 to 72 business hours. Delivery times are estimates only and are governed by our carriers (AusPost/Aramex).
- Mandatory Signature & Chain of Custody: Due to the nature of our products, all gel blasters require a Signature on Delivery.
- Authority to Leave (Waiver of Liability): If you contact the courier to override the signature requirement (e.g., requesting "Leave in Safe Place" or "Authority to Leave"), you assume 100% financial and legal liability. Command Elite Hobbies will not refund or replace lost, stolen, or missing parcels where the signature requirement was bypassed by the customer.
- International Orders: Export orders are shipped strictly on terms where the buyer acts as the Importer of Record. The buyer is 100% responsible for import permits, customs clearance, duties, and taxes. We hold zero liability for international orders delayed, seized, or destroyed by destination customs authorities.
Returns, Refunds & Consumer Rights
Returns and refunds are provided in strict accordance with the Australian Consumer Law (ACL). You are entitled to a repair, replacement, or refund if a product is deemed critically faulty from the manufacturer or significantly different from its description.
- Change of Mind: Not required by law and accepted solely at our discretion. Approved returns will incur a restocking fee of up to 20%. Original shipping costs are non-refundable.
- Voided Warranties: Products that have been misused, physically modified, opened, damaged through improper handling, or used contrary to instructions are stripped of eligibility for return, exchange, or refund.
- Seizures Are Not Faults: The confiscation or destruction of a product by State Police, ABF, or International Customs due to the buyer's failure to comply with local laws does not constitute a "product fault." No refunds will be issued under the ACL for seized goods.
Safety, Use & Warranties
You agree to use all products safely, responsibly, and in accordance with applicable laws. Gel blasters must never be discharged in public or in any way that could cause public alarm. Concealed transport is legally mandated in Queensland. Protective eyewear must be worn at all times during operation.
Modifying gel blasters to fire outside of manufacturer specifications may alter their legal classification and instantly voids any applicable warranty.
Prohibited Conduct
You must not use our Site or products for any unlawful purpose. You are strictly prohibited from attempting to bypass our geographic shipping restrictions, utilizing fraudulent identification, harassing our staff, or interfering with the security features of the Site.
Third-Party Services & User Content
Third-Party Links: Our Site may contain links to third-party websites or payment gateways. We do not control or accept responsibility for third-party content or services. Use of third-party services is at your own risk.
User Content: By submitting reviews, photos, or content to us, you grant Command Elite Hobbies a non-exclusive, royalty-free, perpetual licence to use and publish such content. We reserve the right to remove any content deemed unlawful or misleading.
Limitation of Liability
To the fullest extent permitted by law, Command Elite Hobbies Pty Ltd is not liable for any direct, indirect, incidental, punitive, or consequential damages arising from:
- The purchase, use, misuse, or illegal possession of our products.
- The seizure, confiscation, or destruction of products by domestic law enforcement or international customs authorities.
- Delivery delays, failures, or theft in transit (particularly when Signature on Delivery is waived by the buyer).
- Unauthorised access to your account or data.
Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be legally excluded.
Legal Governance
Indemnification: You agree to indemnify, defend, and hold harmless Command Elite Hobbies Pty Ltd, its directors, and employees against any claims, criminal charges, damages, or legal fees arising out of your breach of these Terms, your violation of state/federal law, or your misuse of our products.
Termination: We may suspend or terminate your access to the Site, or cancel any pending orders without notice, if we suspect you are breaching these Terms or attempting to traffic goods to prohibited states.
Amendments: We reserve the right to update or replace any part of these Terms at our sole discretion. Continued use of our services constitutes acceptance of the revised Terms.
Governing Law: These Terms are governed by the laws of Queensland, Australia. Any legal disputes, including cross-border disputes, shall be subject to the exclusive jurisdiction of the courts of Queensland.
